DoE communication errors
At the end of Term 3, the QTU became aware of an issue with the DoE’s communications to members regarding guaranteed, requested and required transfer outcomes. A number of incorrect emails were sent, which made a stressful time even worse for members.
This matter was immediately raised by the General Secretary, and the DoE has committed to a number of actions to address these communications errors. At the time of writing, it seems to be a communication error rather than a breakdown of the transfer process. The QTU will keep members informed as more information is available.
Transfer appeals
As it is a condition of permanent employment that a teacher may be required to work anywhere in the state, there are limited circumstances in which a teacher can successfully appeal the department’s transfer decisions.
The department’s communication errors are unlikely, as a sole reason, to be enough to secure a successful transfer appeal.
Transfer appeals processes are time sensitive, so it is important that members considering an appeal are aware of and adhere to the following timeframes.
Stage 1 – Local action: Teachers should send an email to their current principal within 28 days to ask for a review of the transfer decision. The email should provide enough details about their situation to help address their concerns and can suggest any actions they want taken. A teleconference should be held between a regional officer, a member of the school’s leadership team and the teacher. You can have a Union Representative or another support person present. The teacher will receive an email confirming the outcome and next steps available.
Stage 2 – Internal review: If Stage 1 does not resolve the matter, you can escalate your case to the regional review panel. There are two separate forms for this stage, one for required transfers and one for requested transfers. The relevant form must be lodged within 14 calendar days of receipt of the written notification of the outcome of Stage 1.
Stage 3 – External review: You may lodge an appeal against the outcome of the internal review with the Queensland Industrial Relations Commission. It is important to note that the evidence provided at Stages 1 and 2 is all the QIRC can consider if the matter proceeds to external review. You have 21 calendar days from the date you receive the written internal review decision. Past cases show the QIRC recognises the DoE’s right, in the absence of compassionate circumstances, to transfer teachers statewide.
